CAMBODIA: NEW VALIDATION COUNTRY IN THE EUROPEAN PATENT APPLICATIONS

As from 1st March 2018, it will be possible to extend the protection conferred by the new European Patent Applications to Cambodia, by the payment of a validation fee.

 

According to the national patent law of Cambodia, pharmaceutical products are excluded from protection till 2033, but European Patents validated in Cambodia can be directed to such products, even though they would not confer rights by the moment.

 

With this agreement, Cambodia becomes the first Asian country which recognizes the effects of the European Patents in its territory, following the path started by other non-European countries such as Morocco and Tunisia.

 

The following map shows the European Patent Convention member States (in red) and those ones where the protection conferred by a European Patent can be extended by the payment of extension or validation fees (in blue), except Cambodia, which is not yet included.
